Please read these Terms of Use carefully as they contain important information about your legal rights, remedies and obligations. Overview
mypromo.co.nz (or “we”, “us” or “our”) hosts and operates an e-commerce ecosystem (the “Platform”) through a network of innovative shopping applications, websites and digital platforms) and we may add Other websites. Among other things, we help (a) social media influencers and creators (“Influencers”) connect and collaborate with brands, advertisers and marketing agencies (“Brands”) to create sponsored marketing campaigns (“Campaigns”) Content (“Content”) ), (b) Brands create content for their marketing campaigns by connecting and collaborating with influencers to create and run campaigns.
We sometimes refer to people who use or access our Platform or Services as “users” and “your” or “you,” depending on the context. If you access the Platform or use the Services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such legal entity, in which case “your” or “you” shall refer to such legal entity. Furthermore, in these Terms, unless the context otherwise requires, words referring to one gender include all genders and words referring to the singular include the plural and vice versa.
Accept terms
By using or accessing the Site and any services offered through the Site or affiliated applications (collectively, the “Services”), you agree to be bound by the following terms and conditions (“Terms of Use” or “Terms”) and our Privacy Policy. Please read these Terms and our Privacy Policy carefully. Our Privacy Policy is available at https://mypromo.co.nz/privacy-policy/ and is incorporated into these Terms by reference. If you do not agree to these Terms, including our Privacy Policy, you are not authorized to obtain information from the Site or Services or otherwise continue to use the Site or Services. Revise
mypromo.co.nz reserves the right, at its sole discretion, to modify or discontinue, temporarily or permanently, the Platform, Services or amend these Terms at any time without prior notice. If we modify these Terms, we will post the modifications on the Site. Modifications to these Terms will automatically be effective upon posting. By continuing to access or use the Platform or Services after we post modifications, you agree to be bound by the modified Terms. If you do not accept the modified Terms, your only recourse is to cease accessing or using the Platform and Services.
Account registration and services
Qualified
By using or accessing our Platform, you represent that you are at least the age of majority in your country, state, or province of residence, or that you are the age of majority in your country, state, or province of residence and you provide us with your Agree to allow any of your minor dependents to use the Platform. You are solely responsible for ensuring that use of the Platform and Services under these Terms is permitted by all applicable laws and regulations in the jurisdiction in which you reside.
General
Our failure to enforce any right or provision of these Terms will not constitute a waiver of our future enforcement of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of mypromo.co.nz. Except as expressly provided in these Terms, the exercise by either party of any remedy under these Terms will be without prejudice to its other remedies under these Terms or otherwise. If, for any reason, an arbitrator or court of competent jurisdiction finds any provision of these Terms to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.
Certain features or areas of the Site and/or App (and your access to or use of certain aspects of the Services or Content) may have different terms and conditions posted, or may require your agreement to and acceptance of additional terms and conditions. If there is a conflict between these Terms and the terms and conditions posted for a particular area of the Site, Services or Content, the latter terms and conditions will prevail when you use or access that area of the Site, Application. , services or content.
By registering or clicking to accept these Terms, you will be deemed to have executed these Terms electronically in accordance with the United States Electronic Signatures in Global and National Commerce Act (the “Electronic Signatures Act”), effective as of the date you register for an account (15 U.S.C. § 7001 et seq.). By creating an account, you confirm that you are able and willing to electronically receive, download and print these Terms, any amendments, and any agreements with other users. Entire agreement
These Terms constitute the complete and exclusive understanding and agreement between mypromo.co.nz and you regarding the Service and supersede and replace all prior understandings or agreements, whether oral or written.

If so, the English version will supersede the translated version.
